What are the implications of MIQUEST use for the statutory requirements of data protection security and confidentiality?

All users of MIQUEST Enquirer are reminded of their ethical and legal obligations when extracting data from clinical systems.

These include obligations to comply with Caldicott principles, NHS Security Guidelines, HSC 2000/009 and the law (e.g. Computer Misuse Act 1990, Data Protection Act 1998, and Human Rights Act 1998).

Furthermore, your organisation may well have additional local patient confidentiality and security procedures in place.

Consideration should be given to the need to obtain informed patient consent if data containing strong patient identifiers (e.g. name, address etc), will be processed.

MIQUEST software, when used in local mode, has features that require practices to approve both the running of the query set and the transmission of the response.

Practices should be made aware of these responsibilities before data extraction is commenced. If you are in doubt of your or your organisation's obligations with respect to Caldicott, Data Protection and security you should consult with your Trust's Caldicott Guardian or Data Protection Officer before using MIQUEST Enquirer software.
